SECOND MEDIATION NOT SUCCESSFUL
Our Insurer, Empire Indemnity, recently requested an early morning meeting in Orlando on Tuesday, April 18, 2006, to continue the mediation process. We were not required to participate in a second mediation, but all of your Board members attended, with the hope the process would result a settlement of the Association’s entire claim. Unfortunately, this did not eventuate despite our efforts to find a solution that would be acceptable to both sides. Empire paid the costs of the mediation, including an experienced and expensive mediator from New York who had successfully mediated settlements with hundreds of the 9-11 victims’ families as well as many hurricane related claims in the Gulf states. Unless there is a change of heart at Zurich/Empire the next step is to complete the appraisal process which should be concluded within 30 days from now. Your Board was given expert guidance by our Attorneys, Bob Freemon and Gary Miller, who were there with us, and who have taken part in many of these very stressful decision making sessions. Let us all pray that the appraisal process will produce an award that is equitable.
