WITH EXECUTIVES AND AN ATTORNEY FROM ZURICH/EMPIRE
INDEMNITY INSURANCE FOR INITIAL MEDIATION SESSION
ON DECEMBER 2, 2005 IN DAYTONA, FLORIDA AT THE OFFICES OF PROFESSIONAL MEDIATOR AND ATTORNEY,
TERRY WHITE, ESQ.
WHILE THE MEETING WAS VERY CIVILIZED AND POLITE AND LASTED FROM 1:00 P.M. UNTIL AFTER 7:00 P.M.
NO SATISFACTORY BASIS FOR A SETTLEMENT WAS REACHED BY THE PARTIES. THIS WAS ANTICIPATED BY OUR
ATTORNEYS AND THE BOARD. THE MEDIATION PROCESS IS SUBJECT TO FLORIDA STATUTES, CHAPTER 44, WHICH REQUIRES THE PARTICIPANTS TO MAINTAIN CONFIDENTIALITY AS TO THE MATTERS DISCUSSED IN THE MEDIATION MEETINGS. A DATE FOR FURTHER MEDIATION DISCUSSIONS HAS NOT BEEN SET. WE ALSO HAVE THE APPRAISAL PROCESS AND A FEDERAL LAWSUIT WITH A JURY AS FURTHER STEPS IN OUR QUEST TO OBTAIN A FAIR SETTLEMENT UNDER OUR INSURANCE CONTRACT WITH EMPIRE. ONE OF THE OBJECTIVES OF THE INSURER SEEMS CLEARLY TO BE TO WEAR DOWN THE MEMBERS IN OUR ASSOCIATION BY THEIR PROLONGED DELAYING TACTICS, HOPING THAT THEY WILL FIND SOME WEAKNESS IN OUR RESOLVE TO RECEIVE AN EQUITABLE SETTLEMENT.
WE BELIEVE THEY ARE UNDERESTIMATING THE HIGH CALIBER OF THE FINE RESIDENTS OF PELICAN POINT II, WHO WILL NOT CAVE IN TO THEIR METHODS.

WE MUST STAND TOGETHER, UNITED IN OUR OBJECTIVE OF A FAIR OUTCOME TO OUR RECOVERY FROM THIS NATURAL CATASTROPHE WHICH HAS BEEN EXACERBATED BY OUR INSURER'S CONTINUED DELAYING TACTICS.
